Intellectual Property Law and Traditional Knowledge Protection: International Frameworks and Nigerian Herbal Medicine Communities

This paper examines the adequacy of international intellectual property law frameworks in protecting the traditional knowledge of Nigerian herbal medicine communities, with a focus on communities in Ondo, Ekiti, and Osun States in the South West geopolitical zone. The Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), the Convention on Biological Diversity (CBD), and the Nagoya Protocol on Access and Benefit Sharing provide the primary international legal architecture relevant to traditional knowledge protection, yet these instruments have been criticised for failing to prevent biopiracy and to adequately reward indigenous knowledge holders. The research adopts a descriptive methodology, drawing on WIPO Intergovernmental Committee deliberations, recent academic literature on traditional knowledge and intellectual property, and ethnographic accounts of herbal medicine practice in South West Nigeria. It critically evaluates the Nigerian Patents and Designs Act and the National Biotechnology Development Agency's policies on traditional knowledge in light of international standards. Findings indicate that Nigerian traditional medicine communities remain largely unprotected against commercial exploitation of their knowledge by pharmaceutical companies and research institutions, both domestic and foreign. The paper also examines model community protocols developed by WIPO and their potential for adoption in the Nigerian context. Recommendations include legislative enactment of a sui generis protection system for traditional knowledge, ratification of the Nagoya Protocol, and community-based documentation of herbal knowledge as a defensive protection measure.
