A Critical Examination of the National Industrial Court of Nigeria: Jurisprudential Evolution, Institutional Effectiveness, and Workers’ Access to Justice

This doctoral study provides a critical jurisprudential, institutional, and access-to-justice analysis of the National Industrial Court of Nigeria (NICN) from its establishment under the Third Schedule of the 1999 Constitution through its transformation into a superior court of record under the 2011 Amendment, and its judicial development up to 2024. While the NICN represents a landmark institutional innovation in Nigerian labour law, critical scholarly analysis of its jurisprudential trajectory, institutional constraints, and effectiveness as an access-to-justice mechanism for workers remains remarkably sparse. Drawing on Critical Legal Theory, Institutional Analysis and Development Framework, and Access to Justice Theory, this study employs a multi-method design comprising systematic doctrinal analysis of 450 NICN judgements from 2012 to 2024, semi-structured interviews with 75 labour judges, barristers, union legal officers, and unrepresented litigants, and quantitative analysis of court administrative data on case volume, disposition time, and representation rates. The original theoretical contribution is a Nigerian Labour Court Effectiveness Framework that distinguishes jurisprudential excellence, institutional capacity, and access equity as separable and potentially conflicting dimensions of court effectiveness, a distinction absent from existing court performance literature. Empirical findings document a progressive jurisprudence in unfair dismissal, collective bargaining, and workplace equality that exceeds many Commonwealth counterparts, alongside severe access barriers for informal economy and unrepresented workers that systematically limit the court's remedial reach. Recommendations include legal aid expansion, NICN circuit sittings in state capitals, and procedural simplification for self-represented litigants.
