Digital Evidence and Admissibility in Nigerian Criminal Trials: Closing the Evidentiary Gap

The increasing prevalence of digital communications, electronic financial records, and social media evidence in criminal cases has exposed significant gaps in Nigeria's evidence law framework. The Evidence Act 2011 contains provisions for computer-generated documents, but rapid advances in digital forensics, cloud computing, and encrypted communications have outpaced the statute's analytical sophistication. This research analyses the admissibility of digital evidence in Nigerian criminal trials, examining the authentication standards, certification requirements, and chain of custody principles applied by courts from 2015 to 2024. A doctrinal methodology was employed, systematically reviewing Federal High Court and state high court decisions in which digital evidence admissibility was contested, supplemented by structured interviews with digital forensics experts, cybercrime prosecutors, and criminal defence lawyers in Lagos and Abuja. Secondary sources include comparative digital evidence studies from England, Kenya, and the United States, and forensic science law scholarship. The study develops an original analytical taxonomy of digital evidence admissibility disputes in Nigerian courts, identifying the most contested evidentiary categories and their resolution patterns. Findings reveal inconsistent judicial application of authentication standards, a tendency toward formalistic rather than reliability-based assessment, and significant prosecutor capacity gaps in digital evidence presentation. The research contributes original doctrinal analysis and recommends legislative amendments to the Evidence Act and prosecutorial training investments to close Nigeria's digital evidence gap.
