Ethnic Minority Rights and Federalism in Cross River State: A Critical Analysis

This study critically analyses the protection of ethnic minority rights within Nigeria's federal system, using Cross River State as the primary site of investigation. Nigeria's ethnic minorities have historically struggled for adequate political representation, cultural recognition, and equitable resource allocation within both federal and state governmental structures, and the Cross River State context provides a rich multi-ethnic setting for examining these dynamics. Using a qualitative research design combining document analysis with in-depth interviews conducted among 36 key informants drawn from minority community leaders, state government officials, lawyers specialising in constitutional rights, and civil society organisations, the study maps the governance mechanisms through which minority claims are articulated, negotiated, and resolved or suppressed. The minority rights framework, the politics of recognition theory, and consociational political theory are applied to evaluate existing arrangements. Findings reveal that while Nigeria's constitutional framework includes provisions against discrimination and promotes federal character representation, these guarantees have not translated into substantive political equality for ethnic minorities in Cross River State's political economy. Minority communities report consistent underrepresentation in the state civil service, limited access to development funds, and cultural marginalisation in state education policy. The South South geopolitical zone context, with its oil resource politics, adds a distinctive distributive dimension to minority rights claims. Recommendations include mandatory ethnic minority representation audits in state civil service appointments, devolution of additional cultural rights to minority communities, and independent monitoring of federal character compliance.
