Terrorism Law and Civil Liberties: An Analysis of the Terrorism Prevention Amendment Act 2013 and Its Application in the North East

Nigeria's Terrorism (Prevention) (Amendment) Act 2013 substantially expanded the counter-terrorism legal framework in response to the Boko Haram insurgency, introducing provisions on designation, freezing of terrorist assets, and extended detention without charge that raise fundamental civil liberties concerns. The application of these measures in North East Nigeria, where emergency security operations have been ongoing, provides a critical empirical context for examining the tension between effective counter-terrorism law and constitutional rights protection. This study analyses the legal framework of the Terrorism Prevention Amendment Act 2013 and its civil liberties implications in the North East geopolitical zone. A doctrinal methodology is applied, reviewing the Act's provisions on detention, designation, and terrorism financing, judicial decisions from the Federal High Court on terrorism-related civil liberties claims, Amnesty International Nigeria reports on detention practices, and comparative analysis of the United Kingdom's Terrorism Act 2000. The study evaluates whether the Act's provisions satisfy the necessity and proportionality requirements of the African Charter on Human and Peoples' Rights. Available counter-terrorism law literature from North East Nigeria identifies detention beyond 24 hours without judicial warrant and absence of habeas corpus access for terrorism detainees as the most documented civil liberties violations. The Counter-Terrorism and Human Rights Proportionality Framework provides the analytical reference. Recommendations address mandatory judicial oversight of terrorism detention and legislative proportionality review of the 2013 Act.
