📖 ABSTRACT/OVERVIEW
The admissibility and probative weight of forensic DNA evidence in Nigerian criminal proceedings is governed primarily by the Evidence Act 2011, which modernised the legal framework for documentary and electronic evidence but contains limited specific provisions on forensic scientific evidence standards. As DNA evidence becomes increasingly available in serious criminal prosecutions including sexual violence, homicide, and terrorism cases, professional clarity on its admissibility requirements, chain of custody standards, and expert witness obligations is critical for prosecutors, defence counsel, and the judiciary. This study professionally examines the legal framework governing DNA evidence admissibility under the Evidence Act 2011, evaluating applicable provisions, judicial practice in receiving DNA evidence, and the adequacy of Nigeria's forensic laboratory accreditation framework. A doctrinal and professional practice methodology is applied, reviewing the Evidence Act 2011, the DNA (Prohibition) Bill 2016, selected court decisions from the Federal High Court and State High Courts involving DNA evidence from 2012 to 2023, and comparative analysis from England and Wales and the United States. The study evaluates chain of custody requirements, expert witness qualification standards, and challenges to DNA evidence reliability. Available forensic evidence literature from Nigeria identifies inadequate National Forensic Science Laboratory accreditation, absence of mandatory DNA evidence protocols, and judicial unfamiliarity with DNA interpretation as the primary professional gaps. The Best Evidence Principle and the ENFSI Guidelines on Forensic DNA Analysis provide the normative reference. Recommendations address a DNA Evidence Regulation and forensic laboratory accreditation law. Keywords: DNA evidence, forensic evidence, Evidence Act 2011, criminal law, Nigeria.
