A Theoretical Investigation of the Constitutional Dimensions of the War on Terror in Nigeria: Security Law, Rights Derogation, and Democratic Accountability

Nigeria's security response to the Boko Haram insurgency, Biafra separatist movements, and Niger Delta militancy has generated an expanding national security legal architecture that raises fundamental theoretical questions about the constitutional dimensions of the war on terror in a federal democratic state. The theoretical tensions between effective counter-terrorism governance, constitutional rights protection, and democratic accountability in Nigeria have not been examined through a systematic theoretical lens that integrates security law theory, constitutional theory, and democratic governance theory. This study develops an original theoretical investigation of the constitutional dimensions of Nigeria's counter-terrorism legal framework, examining how security law expansion interacts with constitutional rights derogation provisions, democratic accountability mechanisms, and federalism constraints. The methodology applies a Critical Constitutional Security Law methodology combining doctrinal analysis of the Terrorism Prevention Act 2011 and its 2022 replacement, the SAMA Act, the Defence Intelligence Agency Act, and relevant judicial decisions, with a Critical Discourse Analysis of National Security Council statements and National Assembly security oversight records from 2011 to 2023, and comparative theoretical analysis from the United Kingdom and Colombia. Security Exceptionalism Theory, Democratic Security Governance Theory, and the Constitutional State of Exception Framework of Carl Schmitt critically analysed through a liberal constitutional lens provide the theoretical architecture. The study's original contribution is a Constitutional Counter-Terrorism Accountability Framework specifically designed for federal multi-ethnic democracies.
