Analytical Examination of Islamic Penal Philosophy and Rehabilitation: Implications for Prison Reform in Northern Nigeria

Classical Islamic penal philosophy integrates deterrence, retribution, and rehabilitation as complementary objectives of criminal punishment, and the rehabilitation dimension of this framework, which includes provisions for Tawba (repentance), community reintegration, and skill development for convicted persons, offers an analytically significant alternative to purely punitive approaches in northern Nigerian criminal justice. This study analytically examines Islamic penal philosophy with particular focus on its rehabilitation component and derives implications for prison reform in northern Nigeria. A doctrinal and policy analysis methodology is applied, reviewing classical Islamic penal theory from Hanafi, Maliki, and Hanbali schools on the purposes of punishment, analysing northern Nigerian Sharia Penal Code provisions for rehabilitation elements, and examining the Nigerian Corrections Act 2019 rehabilitation framework for compatibility with Islamic penal philosophy. Forty correctional officials and ten Islamic scholars in Kano, Zamfara, and Sokoto are interviewed on the integration of Islamic rehabilitation principles in northern Nigerian facilities. Available Islamic penology literature identifies a significant gap between the classical Islamic emphasis on Tawba-based rehabilitation and the predominantly punitive practice in northern Nigerian correctional institutions. The Maqasid al-Shariah objective of protecting life and the Islamic principle of Islah (reform) provide the normative framework. Findings are expected to reveal doctrinal resources for rehabilitation significantly underutilised in practice. Recommendations address Islamic rehabilitation programmes, Quran-based counselling integration, and vocational training in correctional facilities across northern Nigerian states.
