A Critical Theory of Access to Justice in Nigerian Private Law: Structural Barriers and Transformative Solutions

Access to justice in Nigerian private law is systematically constrained by structural barriers including cost, procedural complexity, legal illiteracy, geographic inaccessibility, and institutional corruption that disproportionately exclude the poor, women, rural populations, and ethnic minorities from effective participation in civil legal processes. This study develops a critical theory of access to justice in Nigerian private law, drawing on critical legal studies, post-colonial legal theory, Amartya Sen's capabilities approach, and empirical research conducted across all six geopolitical zones of Nigeria involving 500 research participants including litigants, legal aid workers, court officials, and civil society representatives. Using a multi-site ethnographic and doctrinal methodology, the research maps the structural mechanisms through which Nigerian private law's formal universalism produces substantive exclusion, analysing court fee structures, limitation rules, legal aid provision, judicial capacity, and alternative dispute resolution availability across regional contexts. The study advances an original Critical Access to Justice Framework (CAJF) as its theoretical contribution, which conceptualises access to justice not merely as procedural availability but as the substantive capability to obtain effective legal redress. The CAJF integrates transformative institutional design proposals grounded in the Nigerian constitutional framework. Findings demonstrate that access to justice failures in Nigeria are structural and systematic rather than incidental, requiring transformative rather than incremental reform. Recommendations include a Right to Civil Legal Aid Act, court fee abolition for specified civil claims, mobile justice programmes, and expanded alternative dispute resolution infrastructure.
