Administrative Law and Public Service Accountability: An Examination of Disciplinary Procedures in the Kano State Civil Service

Public service accountability through effective administrative disciplinary procedures is fundamental to the rule of law and good governance in Nigerian states. However, civil service disciplinary practices in many Nigerian states operate with limited transparency, procedural irregularity, and inadequate remedial mechanisms for aggrieved civil servants. This study examines the administrative law framework governing disciplinary procedures in the Kano State Civil Service, with a focus on compliance with the right to fair hearing and natural justice principles. A doctrinal and empirical methodology is adopted, reviewing the Kano State Public Service Rules, the State Civil Service Commission Regulations, judicial decisions of the National Industrial Court and the Kano State High Court on civil service discipline, and documented disciplinary cases obtained from the Kano State Civil Service Commission from 2018 to 2023. The study evaluates procedural compliance, appellate mechanisms, and the availability of judicial review of disciplinary decisions. Available administrative law literature from North West Nigeria identifies summary dismissal without hearing, failure to communicate specific charges, and inadequate appellate procedures within the civil service as the most frequent procedural violations. The Natural Justice Principles and the Administrative Law Fairness Standard provide the analytical framework. Recommendations address revision of Kano State Public Service Rules, mandatory procedural training for discipline committees, and strengthened National Industrial Court access for aggrieved civil servants.
