Analytical Examination of Prison Overcrowding as a Constitutional Rights Violation in Nigeria: Evidence from Kogi and Niger States

Prison overcrowding in Nigeria's custodial centres constitutes a systemic constitutional rights violation, implicating Section 34 rights against inhuman and degrading treatment, Section 35 rights to personal liberty, and Section 36 rights to fair trial through prolonged pre-trial detention. Custodial centres in North Central states including Kogi and Niger routinely hold between three and ten times their designed capacity, creating conditions that judicial inspection committees have documented as unconstitutional. This study analytically examines prison overcrowding as a constitutional rights violation in Kogi and Niger States, evaluating the legal basis of overcrowding-related rights claims, available judicial remedies, and the adequacy of existing legal frameworks for addressing systemic custodial rights violations. A mixed doctrinal and empirical methodology is applied, reviewing the Correctional Services Act 2019, constitutional rights provisions, Nigerian Prison Service annual reports, judicial inspection committee findings from 2018 to 2023, and comparative constitutional law from India, where the Supreme Court has issued systemic remedial orders for prison overcrowding. The study evaluates whether Nigerian courts can and should issue structural injunctions ordering systemic reforms of custodial centres as a rights remedy. Available correctional law literature from Nigeria identifies prolonged pre-trial detention as the dominant contributor to overcrowding and the absence of supervised release programmes as the most analytically significant legal gap. The Right Against Inhuman Treatment Framework and Minimum Standard Rules for Prisoners provide the normative reference. Findings recommend structural injunction jurisprudence development and a pretrial diversion law.
