Archaeological Finds Reporting and Emergency Response Protocols for Construction Companies in Lagos State

Lagos State's construction boom generates frequent encounters between development activity and buried archaeological deposits, yet the formal mechanisms by which construction companies are required to report unexpected finds and cease activity pending archaeological assessment remain poorly understood and inconsistently applied. This study develops standardized archaeological finds reporting and emergency response protocols for use by construction companies operating in Lagos State, drawing on legal analysis of applicable federal and state heritage legislation, interviews with construction industry representatives, NCMM Lagos office staff, and archaeological consultants active in the state. A review of thirty construction project files provided to NCMM over the past five years indicates that reporting practice is highly inconsistent, with many companies either unaware of their legal obligations or reluctant to incur project delays associated with archaeological assessment. The study identifies the absence of a simple and widely publicized reporting procedure as a primary barrier to compliance, alongside insufficient contractor-facing communication from NCMM about what triggers a reporting obligation. Drawing on comparative analysis of watching brief and chance finds protocols from the United Kingdom, South Africa, and Ghana, the study presents a draft Lagos State Construction Sector Archaeological Protocol, covering the identification of find triggers, notification timelines, interim site protection measures, and an expedited NCMM response procedure to minimize project delays. The protocol was reviewed by construction industry and NCMM representatives before finalization.
