Constitutional Law and National Security: A Professional Examination of the Directorate of State Security Service Powers and Oversight

The Directorate of State Security Service (SSS) is Nigeria's principal domestic intelligence and security agency, with broad powers of surveillance, arrest, and detention. Despite operating under the National Security Agencies Act, the SSS has attracted persistent allegations of operating beyond its legal mandate, including unauthorised detention of citizens, obstruction of court orders, and surveillance of political opponents. This study professionally examines the constitutional and statutory framework governing SSS powers, their exercise within constitutional bounds, and the adequacy of parliamentary and judicial oversight mechanisms. A doctrinal methodology is applied, reviewing the National Security Agencies Act, relevant provisions of the 1999 Constitution, the Administration of Criminal Justice Act on lawful arrest and detention, documented cases of SSS non-compliance with court orders from 2015 to 2023, and comparative analysis from the United Kingdom's Security Service Act 1989. The study evaluates the adequacy of the National Assembly Intelligence Committee oversight role and judicial enforcement of constitutional rights against SSS actions. Available security law literature from Nigeria identifies consistent contempt of court through repeated re-arrest of judicially released detainees and absence of effective parliamentary intelligence oversight as the most documented professional concerns. The Democratic Intelligence Oversight Framework of the Geneva Centre for Democratic Control of Armed Forces and the Constitutional Accountability Theory provide the normative reference.
