Critical Examination of the Integration of Free, Prior and Informed Consent Principles into Nigerian Mining Law and Practice

Free, prior, and informed consent (FPIC) is a foundational principle of indigenous and community rights in natural resource governance, enshrined in the United Nations Declaration on the Rights of Indigenous Peoples and increasingly incorporated into international mining finance standards. Nigeria's mining law and practice do not formally adopt FPIC, and the implications of this absence for communities affected by mining have not been critically examined in legal and governance scholarship. This dissertation conducts a critical examination of FPIC integration into Nigerian mining law and practice, combining legal doctrinal analysis with empirical field investigation of consent processes at mining operations in six geopolitical zones. Doctrinal analysis evaluates the compatibility of Nigeria's Minerals and Mining Act 2007, Land Use Act 1978, and Environmental Impact Assessment Act 1992 with FPIC principles under international law. Field research involving 72 community-level hearings, legal analysis of 18 mining licence application processes, and 140 interviews with community members, legal practitioners, and Ministry officials examines how consent is actually sought and recorded in practice. Findings reveal that current statutory consultation requirements fall substantially short of FPIC standards in areas including the timing of community engagement, the quality of information provided, the right to withhold consent, and remedies for non-compliance. An original FPIC integration framework specific to the Nigerian legal and customary governance context is developed, drawing on comparative experience from the Philippines, Canada, and South Africa. Legislative reform recommendations are provided with constitutional law analysis supporting their compatibility with the Nigerian federal system.
