Developing an Original Theoretical Framework for Corporate Social Responsibility as Legal Obligation in Nigerian Oil and Gas Law

Corporate social responsibility in the Nigerian oil and gas sector has historically been voluntary and inadequately enforced, yet the Petroleum Industry Act 2021 has introduced legally binding host community development obligations that represent a significant step toward CSR legalisation. This study makes an original theoretical contribution by developing a Legal CSR Obligation Theory for Nigeria's Oil and Gas Sector (LCOT-OGN) that provides a coherent normative and doctrinal framework for understanding, developing, and enforcing CSR as legal obligation rather than voluntary practice. The LCOT-OGN draws on stakeholder theory, constitutional environmental rights, international human rights law applicable to business, and socio-legal analysis of oil and gas community relations to develop a comprehensive theory of legally obligatory CSR in the Nigerian petroleum context. Original contributions include a Mandatory-Voluntary CSR Spectrum that maps the evolution of Nigerian oil sector CSR from voluntary philanthropy to legally enforceable community rights, a Legal Obligation Typology identifying the different doctrinal bases for CSR obligations across constitutional, statutory, contractual, and tortious law sources, and an original normative model for a Petroleum Community Rights Act that would comprehensively codify community rights against petroleum operators. The framework is developed through systematic doctrinal analysis, comparative analysis of CSR legal frameworks in Angola, Brazil, and Norway, and fieldwork interviews with 50 host community leaders, oil company legal officers, and environmental lawyers in the Niger Delta. The study constitutes an original and significant contribution to both CSR theory and Nigerian petroleum law scholarship.
