Electoral Violence and the Law: A Case Study of the 2023 General Elections in Plateau State

Electoral violence poses a profound threat to democratic consolidation in Nigeria, undermining voter participation, institutional legitimacy, and the rule of law. The 2023 general elections in Plateau State, located in the North Central geopolitical zone, were marked by widespread reports of intimidation, ballot tampering, and post-election violence. This research examines the legal responses to electoral violence in Plateau State during the 2023 election cycle, focusing on the Electoral Act 2022, the criminal jurisdiction of the Independent National Electoral Commission, and prosecutorial action by state and federal law enforcement agencies. A qualitative research methodology was adopted, involving document analysis and structured interviews with electoral tribunal lawyers, INEC officials, and civil society election observers. Secondary data was sourced from tribunal rulings, INEC reports, and independent observer assessments published between 2022 and 2024. The findings indicate that while the Electoral Act 2022 strengthened provisions for prosecuting electoral offences, conviction rates for electoral violence perpetrators remain negligible due to poor evidence preservation and limited prosecutorial capacity. The research also identifies partisan influence over law enforcement as a critical structural impediment. Recommendations include establishing a dedicated electoral crimes prosecution unit, providing independent funding for the judiciary during election petition proceedings, and strengthening INEC's enforcement partnerships with security agencies.
