International Child Protection Law and Cross-Border Child Custody: Practical Considerations for Nigerian Family Law Practitioners

This study examines international child protection law in the context of cross-border child custody disputes involving Nigerian parties, drawing on the Hague Convention on the Civil Aspects of International Child Abduction and customary international law on parental responsibility. Cross-border child custody cases involving Nigerian parents are increasingly common, particularly in diaspora communities in the United Kingdom, the United States, and Canada, yet Nigerian legal practitioners often lack familiarity with the international legal frameworks governing such disputes. Using a professional legal practice methodology, the research analyses the Hague Abduction Convention's return mechanism, its best interests of the child standard, and the convention's interaction with Nigerian family law and sharia principles applicable in northern states. It examines how Nigerian courts have handled cross-border custody cases in practice, drawing on reported decisions from the Federal High Court and state courts in Lagos, Abuja, and Kano. The paper identifies critical knowledge gaps among Nigerian family law practitioners, including limited awareness of Hague procedures, inadequate training on international child law, and inconsistent judicial treatment of foreign custody orders. It also examines the role of the federal government's Central Authority, established under the Hague Abduction Convention, in managing incoming and outgoing abduction cases. Findings indicate that Nigeria's implementation of the Hague Abduction Convention is hampered by limited Central Authority resources and inadequate legal aid for affected parents. Recommendations include targeted training for family law practitioners, enhanced Central Authority funding, and development of a national best practices guide on cross-border child custody.
