Legal Aspects of Employment Termination and Wrongful Dismissal Claims in Nigerian Private Sector Organisations

Employment termination disputes constitute a significant volume of claims before Nigeria's National Industrial Court and state high courts, reflecting the complex interaction between contractual employment terms, statutory protections, and evolving judicial doctrines governing employer conduct. Private sector organisations across various industries face recurring challenges in managing termination processes in compliance with the Labour Act, the Employee Compensation Act, and the procedural requirements developed through judicial decisions. This study examines the legal aspects of employment termination and wrongful dismissal claims in Nigerian private sector organisations, drawing on a review of National Industrial Court decisions from 2019 to 2024 and structured interviews with human resources directors and employment law practitioners in Lagos, Abuja, and Port Harcourt. Secondary sources include employment law texts, NBA Labour Law Section publications, and academic articles on industrial justice. Findings indicate that inadequate documentation of disciplinary processes, failure to conduct fair hearings before termination, and ambiguous contractual provisions regarding notice entitlements are the most frequent sources of successful wrongful dismissal claims against employers. Compensation awards by the National Industrial Court have increased significantly, incentivising investment in preventive employment law compliance. Recommendations include development of model termination procedure manuals for HR departments, mandatory legal review of employment contracts at hiring stage, and judicial practice directions to accelerate wrongful dismissal case management. This research provides practical professional guidance for employment law and HR management practitioners.
