Legal Pluralism and Constitutional Democracy in Nigeria: Developing a Normative Theory of Legitimate Pluralism

Nigeria's legal system encompasses constitutional law, English common law, Islamic personal law, and hundreds of distinct customary law systems, creating a degree of legal pluralism unmatched in contemporary constitutional democracies. This complexity generates fundamental tensions between constitutional commitments to equality, non-discrimination, and the rule of law on one hand, and the state's recognition of legal diversity on the other. Existing pluralism scholarship has primarily described Nigerian legal diversity without developing the normative criteria required to distinguish legitimate from illegitimate manifestations of legal pluralism within a constitutional democratic framework. This doctoral research addresses this scholarly gap by developing an original normative theory of legitimate legal pluralism for Nigeria, making a foundational contribution to the intersection of constitutional theory and legal pluralism scholarship. An extended legal theory methodology is employed, drawing on Dworkin's interpretive theory, African communitarian philosophy, constitutional pluralism scholarship from the EU, and postcolonial legal theory. Doctrinal analysis examines the constitutional text, Supreme Court pluralism decisions, and ECOWAS human rights jurisprudence from 2010 to 2024. Secondary sources include legal pluralism scholarship, African political philosophy, and comparative constitutional law from India and South Africa. The research contributes four original scholarly achievements: a systematic critique of existing pluralism theories applied to Nigeria; an original Normative Criteria Framework for evaluating legitimate legal pluralism; constitutional amendment proposals to embed pluralism governance principles; and a theory of judicial minimum standards applicable to all recognised legal orders in Nigeria.
