The Concept of Shura (Consultation) in Islamic Law and Democratic Governance in Kaduna State

Shura (consultation) is an established principle of Islamic governance jurisprudence derived from Quranic instruction and Prophetic practice, and contemporary Islamic legal scholars debate its implications for democratic participation, electoral representation, and legislative decision-making in Muslim-majority states. In Kaduna State, where Islamic political thought intersects with Nigeria's democratic constitutional framework, the relevance of Shura to state governance deserves examination. This study examines the doctrinal basis of Shura in Islamic jurisprudence and its relevance to democratic governance practices in Kaduna State. A descriptive analytical methodology is adopted, reviewing classical Islamic political jurisprudence texts on Shura, Kaduna State governance structures, and conducting interviews with fifteen Islamic scholars and ten legislative officials across the state. The study evaluates the doctrinal forms of Shura (binding versus advisory), the qualifications of the Ahl al-Hall wa al-Aqd (qualified consultants), and the compatibility of Shura principles with Nigeria's representative democracy model. Existing literature from northern Nigerian Islamic political thought identifies Shura as broadly compatible with democratic participation while maintaining distinctions from majoritarian democracy. The Islamic political jurisprudence of Ibn Taymiyya and contemporary scholars like Yusuf al-Qaradawi provides the analytical framework. Findings are expected to reveal significant doctrinal support for democratic participation within an Islamic framework. Recommendations address integration of Shura-based participatory governance into Kaduna State public administration discourse and Islamic civic education programmes.
