The Concept of Ummah and Its Implications for Nigerian Islamic Law Policy-Making: An Analytical Study

The concept of Ummah (the global Muslim community) has been invoked in northern Nigerian Islamic law policy discourse to justify the adoption of Sharia codes that conform to transnational Islamic legal standards rather than uniquely Nigerian social conditions. The analytical examination of how Ummah ideology influences Islamic law policy-making in Nigeria, and whether it promotes or impedes contextually appropriate legal reform, fills a significant gap in the political sociology of Nigerian Islamic law. This study analytically examines the Ummah concept and its influence on Islamic law policy-making in northern Nigerian states. A doctrinal and social-legal methodology is applied, reviewing classical Islamic scholarship on the Ummah doctrine, analysing policy documents and legislative debates from the Sharia re-implementation period in twelve northern states from 1999 to 2023, and conducting structured interviews with twenty Islamic legal scholars and fifteen political actors engaged in Sharia policy-making. The study evaluates how Ummah ideology has shaped legislative choices, the extent to which transnational Islamic legal influences have displaced locally generated juristic reasoning, and the implications for the relevance of adopted Sharia codes to Nigerian social conditions. Available political sociology of Islamic law literature from Nigeria identifies the 1999 Sharia re-implementation as partly driven by Ummah solidarity motivations independent of local community legal needs. The classical Islamic political doctrine of Ummah and Benedict Anderson's imagined communities theory provide complementary analytical frameworks. Findings are expected to reveal significant transnational influence at the expense of contextual relevance.
