Professional Standards in International Arbitration: Capacity Building Needs for Nigerian Legal Practitioners

This study examines the capacity building needs of Nigerian legal practitioners in the field of international arbitration, focusing on professional standards applicable under leading institutional rules including those of the International Chamber of Commerce (ICC), the London Court of International Arbitration (LCIA), and the ICSID Convention. As Nigeria's economy continues to attract foreign investment and international commercial relationships multiply, demand for practitioners competent in international arbitration has grown significantly. The research adopts a professional assessment methodology, drawing on surveys of Nigerian lawyers, analysis of arbitration case statistics, and a review of training curricula offered by the Lagos Court of Arbitration, the Chartered Institute of Arbitrators Nigeria Branch, and Nigerian law faculties. It evaluates the gap between international arbitration professional standards, including those on conflict of interest, confidentiality, procedural fairness, and ethical conduct, and the current knowledge base of Nigerian practitioners. The paper also examines the impact of recent reforms in Nigerian arbitration law, including the Arbitration and Mediation Act of 2023, on professional practice requirements. Findings reveal significant skill gaps in areas including tribunal secretary conduct, emergency arbitration procedures, and the drafting of arbitration clauses tailored to Nigerian commercial contexts. Recommendations include mandatory arbitration training modules in Nigerian law programmes, structured professional development pathways for arbitration practitioners, and strengthened collaboration between Nigerian arbitral institutions and international counterparts.
