International Environmental Law and Corporate Responsibility: Managing Environmental Liability in Nigerian Agribusiness

This study examines the international environmental law obligations applicable to Nigerian agribusiness corporations and the management of environmental liability in this sector, focusing on large-scale agricultural operations in the North Central zone, particularly in Niger and Kwara States where commercial farming activities have expanded significantly. International environmental law instruments including the Convention on Biological Diversity, the Ramsar Convention on Wetlands, and the UN Guiding Principles on Business and Human Rights impose obligations relevant to agribusiness operations affecting biodiversity, wetlands, and community land rights. Using a professional environmental management methodology, the research analyses corporate environmental liability standards under Nigerian law, the international obligations of parent companies headquartered in OECD states with Nigerian agribusiness subsidiaries, and the environmental impact assessment requirements under the Environmental Impact Assessment Act. It examines specific cases where agribusiness expansion has led to deforestation, water source depletion, and community land disputes, assessing the legal remedies available to affected communities. The paper also evaluates voluntary sustainability certification schemes including Rainforest Alliance and the Roundtable on Sustainable Palm Oil as supplementary compliance instruments. Findings indicate that corporate environmental liability management in Nigerian agribusiness is inadequate, with many operators failing to conduct meaningful environmental impact assessments and lacking effective community grievance mechanisms. Recommendations include stricter EIA enforcement by NESREA, mandatory community benefit agreements, and corporate adoption of international sustainability certification standards.
