Flaring Penalties and Regulatory Compliance Among Upstream Operators in Imo State

This study examines the effectiveness of gas flaring penalties imposed on upstream petroleum operators in Imo State, South East Nigeria, with particular attention to compliance behaviour under the Associated Gas Framework Regulations. Despite multiple government deadlines for ending routine flaring, Nigeria continues to rank among the world's top gas flaring nations. Using a descriptive quantitative approach, the research analyses flaring data published by the Nigerian Upstream Petroleum Regulatory Commission (NUPRC) from 2020 to 2024, cross-referenced with penalty issuance records and operator-level compliance reports for Imo State. Structured interviews are conducted with eight petroleum engineers and four regulatory officers to provide qualitative context. The study finds that penalty amounts are too low to incentivise behavioural change and that enforcement is inconsistent across operators of varying sizes. The research recommends a tiered penalty structure linked to operator production volumes and a transparent public disclosure regime for flaring metrics. These findings contribute to the national conversation on Nigeria's gas utilisation targets and are relevant to energy law students, regulatory officials, and environmental policy practitioners.
