Oil Pollution and Public Health: A Legal Analysis of the Liability of Petroleum Operators in Ogbia LGA, Bayelsa State

This study conducts a legal analysis of the liability of petroleum operators for public health impacts of oil pollution in Ogbia Local Government Area, Bayelsa State, South South Nigeria. Ogbia LGA, the birthplace of the Ijaw political tradition and host to significant oil infrastructure, has experienced chronic oil pollution events that public health studies link to elevated rates of waterborne disease and respiratory illness. Using a qualitative doctrinal and empirical mixed approach, the research analyses relevant Nigerian tort law principles, environmental provisions of the PIA 2021, and published public health impact assessments for Ogbia conducted between 2020 and 2024. Community interviews with fifteen residents and focus group discussions with health workers supplement documentary data. Findings indicate significant legal hurdles for community-level plaintiffs, including causation difficulties and lengthy litigation timelines. The study recommends the introduction of a reverse burden of proof in oil pollution civil claims and a statutory health compensation fund financed by operator contributions.
