Trade Dispute Resolution Mechanisms and Their Effectiveness for Nigerian Exporters in International Markets

This study investigates the effectiveness of trade dispute resolution mechanisms available to Nigerian exporters when conflicts arise with foreign buyers, importers, or trade partners in international markets. Nigerian exporters frequently encounter disputes involving non-payment, contract repudiation, quality rejection claims, and cargo insurance disagreements, yet the institutional capacity for resolving these disputes efficiently and cost-effectively remains underdeveloped. The study adopts a descriptive and applied research design, collecting primary data through structured questionnaires and semi-structured interviews with 50 Nigerian export companies with documented international dispute experience and with officials from the Lagos Court of Arbitration, the Nigeria-British Chamber of Commerce, and the Nigerian Shippers' Council. Descriptive statistics and thematic analysis are applied. The theoretical framework draws on the international commercial law framework, transaction cost economics, and the institutional theory of dispute resolution. The study examines the utilisation rates and effectiveness perceptions of mechanisms including international commercial arbitration, mediation through bilateral chambers of commerce, documentary credit dispute resolution through banking channels, and litigation in foreign jurisdictions. Findings are expected to reveal that most Nigerian exporters lack awareness of arbitration options and default to unresolved disputes or costly litigation, with significant implications for export revenue recovery and long-term trading relationships. Recommendations include establishing a dedicated trade dispute advisory service through the Nigerian Export Promotion Council, mandatory trade contract clause training for exporters, and expansion of Nigeria's accession to international commercial arbitration conventions.
