A Theoretical Examination of the Relationship Between Maritime Law Implementation and Safety Outcomes in Sub-Saharan African Coastal States: Comparative Analysis with Nigerian Implications

The translation of international maritime law instruments into domestic safety outcomes in sub-Saharan African coastal states is mediated by institutional, political economy, and technical capacity factors that have not been theorised systematically. This study conducts a theoretical examination of the relationship between maritime law implementation quality and maritime safety outcomes across sub-Saharan African coastal states, with a focus on deriving implications for Nigerian maritime regulatory reform. The research employs a comparative case study methodology examining six sub-Saharan African coastal states selected to provide variation in maritime law implementation quality and safety outcome indicators: Nigeria, South Africa, Ghana, Tanzania, Kenya, and Senegal. Data were collected from IMO member state audit reports, port state control deficiency databases, maritime accident statistics, and semi-structured interviews with forty-two maritime legal and regulatory experts across the six states. A theoretical model of implementation quality is developed drawing on regulatory governance theory, institutional economics, and legal transplantation theory. The model proposes that maritime law implementation quality is determined by the interaction of three factors: administrative technical capacity, political enforcement commitment, and stakeholder normative alignment with the values underlying the law. Comparative analysis confirms the model's explanatory power and identifies Nigeria as characterised by moderate technical capacity but below-average political enforcement commitment and stakeholder alignment.
