A Theoretical and Empirical Investigation of Judicial Independence and Commercial Law Certainty in Nigeria

Judicial independence is theoretically essential to the rule of law and commercial certainty, and its relationship with commercial law outcomes in the Nigerian judiciary has not been investigated through an integrated theoretical and empirical approach. This study develops an original analytical framework for assessing judicial independence as it affects commercial law outcomes in Nigerian courts, and empirically tests this framework using novel metrics. The theoretical component draws on constitutional law theory, principal-agent models of judicial behaviour, and comparative judicial independence indices to develop a Nigerian Judicial Commercial Certainty Index (NJCCI). The NJCCI measures commercial law certainty across five dimensions: consistency of precedent application, contract enforcement predictability, arbitration award enforceability, property rights protection in commercial disputes, and judicial corruption vulnerability. The index is constructed using a combination of legal expert assessments, judicial decision coding, and institutional data for 2016 to 2023. Structural equation modelling tests the relationship between measured judicial independence dimensions and NJCCI outcomes across 12 state commercial court jurisdictions. Results confirm that security of tenure and financial independence of judges are the strongest predictors of commercial certainty scores. Specialised commercial division presence improves the precedent consistency dimension significantly. Corruption vulnerability is the most damaging individual dimension for overall commercial certainty. The study constitutes an original methodological and empirical contribution to Nigerian judicial quality research and proposes evidence-based recommendations for judicial independence and commercial certainty reform targeting the weakest-performing jurisdictions.
