Developing an Original Methodology for Measuring Rule of Law Deficits in Nigerian Business Law Administration

Rule of law deficits in Nigerian business law administration are frequently cited as major barriers to economic development, yet the measurement of these deficits has relied on aggregate governance indices that do not provide sufficiently granular or actionable information for business law reformers. This study makes an original methodological contribution by developing a Nigerian Business Law Rule of Law Deficit Index (NBLRDI), a sector-specific, multi-dimensional measurement framework for identifying, disaggregating, and tracking rule of law deficits in Nigerian business law institutions and processes. The methodological framework is developed through three original contributions: an original conceptual disaggregation of rule of law into six dimensions relevant to business law (legality, legal certainty, equality before the law, accountability, access to justice, and enforcement effectiveness); an original data collection protocol combining legal practitioner expert surveys, judicial decision analysis, regulatory enforcement record coding, and business enterprise survey data for 10 Nigerian business law regulatory domains; and an original index construction methodology with verification through comparison to existing rule of law indicators. The NBLRDI was piloted across 12 regulatory domains including tax law, land registration, contract enforcement, company law, and competition law using data collected over 18 months through engagement with 300 practitioners and 500 regulated entities across all six geopolitical zones. Results demonstrate significant inter-domain variation in rule of law quality, with land registration and contract enforcement showing the deepest deficits and tax administration showing relative comparative strength. The study constitutes an original methodological contribution enabling targeted, evidence-based business law reform programming in Nigeria.
