An Investigation into Environmental Conflict Resolution Mechanisms in Mining Communities of Plateau State

Environmental conflicts arising from mining activities generate complex disputes between communities, extractive companies, and regulatory bodies in Nigeria's Middle Belt zone, yet the institutional mechanisms available for resolving these conflicts have received little theoretical or empirical attention. This doctoral research investigates the formal and informal conflict resolution mechanisms operating in mining communities of Plateau State, with particular attention to their effectiveness, accessibility, and implications for environmental justice outcomes. The study employs a legal geography framework combined with socio-legal empirical methods, conducting 24 months of fieldwork across eight case mining communities in Jos North, Barkin Ladi, and Bassa Local Government Areas. Data collection combines 90 in-depth interviews with community members, traditional rulers, mining company representatives, legal practitioners, and state agency officials, documentary analysis of adjudication records, and 12 focus group discussions with affected households. Dispute case analysis traces resolution processes and outcomes for 48 documented environmental conflicts. Findings reveal a highly fragmented dispute resolution landscape in which formal legal pathways are inaccessible to most affected community members due to cost and procedural complexity, while customary mechanisms lack authority over corporate actors. National Environmental Standards and Regulations Enforcement Agency administrative procedures are used infrequently and generate compliance delays averaging three years. Communities with stronger collective organisations achieve meaningfully better resolution outcomes, demonstrating the importance of organisational capacity in accessing justice. The study contributes an original theory of environmental dispute resolution ecology applicable to Nigerian extractive contexts and proposes an integrated conflict resolution framework combining statutory reform, alternative dispute resolution mechanisms, and community legal empowerment.
