Developing an Original Methodology for Resolving Apparent Conflicts Between Ahadith and Contemporary Rights Norms in Nigerian Islamic Law

Apparent conflicts between specific Prophetic traditions (Ahadith) and contemporary universal rights norms create the most contested doctrinal challenges in applied Islamic law, and their resolution requires a principled jurisprudential methodology that respects both the authority of the Sunnah and the compelling claims of human dignity and contemporary rights. In Nigeria, several contested Ahadith on gender roles, religious minorities, and criminal punishment have been invoked in Sharia court decisions and legislative provisions in ways that generate rights tensions. This study develops an original methodology for resolving apparent conflicts between Ahadith and contemporary rights norms in the Nigerian Islamic law context. A theoretical and applied doctrinal methodology is applied across three phases. Phase one constructs the conflict resolution methodology through systematic engagement with the science of Hadith ('Ilm al-Hadith), the hermeneutical principles of Asbab al-Wurud (contexts of revelation), the theory of Maqasid al-Shariah, and the contextual reading methodology of scholars including Fazlur Rahman, Nasr Hamid Abu Zayd, and Abdullah Saeed. Phase two applies the methodology to fifteen identified conflict points between Ahadith invocations in Nigerian Sharia decisions and rights norms. Phase three subjects the methodology to critical scholarly review through structured dialogue with fifteen Islamic scholars in Nigeria. The original contribution is a six-principle Northern Nigerian Contextual Hadith Interpretation Methodology that provides a structured approach to apparent Hadith-rights conflicts without sacrificing Sunnah authority or rights protection.
