A Professional Examination of the Legal Framework for Trade Marks and Brand Enforcement in Nigeria’s Fast Moving Consumer Goods Sector

Brand protection in Nigeria's fast-moving consumer goods market faces severe challenges from counterfeiting, grey market goods, and online platform infringement, requiring comprehensive legal strategies that extend beyond Trademarks Act registration to encompass customs seizures, criminal prosecution, and platform liability enforcement. This study provides a professional examination of trademark enforcement mechanisms available to FMCG companies in Nigeria, drawing on experiences of five major brand owners in beverages, personal care, and food sectors. Data were collected through structured interviews with brand protection managers and trademark attorneys, supplemented by analysis of 25 trademark enforcement actions, NAFDAC seizure records, and customs interception data from 2019 to 2023. Results indicate that ex parte injunctions are the most effective interim brand protection tool but are inconsistently granted across state divisions of the Federal High Court. Customs recordal of registered trademarks with Nigeria Customs Service produces seizure outcomes but operational responsiveness is uneven. Criminal prosecution of counterfeit operators is rare and conviction rates low due to identification and evidence challenges. Online marketplace enforcement through platform take-down requests lacks a legal mandate in Nigeria. The study concludes that FMCG brand protection in Nigeria requires a multi-track strategy combining legal enforcement with market monitoring technology and recommends enactment of mandatory online platform brand protection obligations.
