An Original Investigation into the Theoretical Foundations of Counter-Terrorism Policing in Democratic States

Counter-terrorism policing in democratic states creates fundamental tensions between security effectiveness and liberal democratic rights protections, and original theoretical investigation of these tensions as they manifest in the specific Nigerian democratic context contributes to both democratic theory and counter-terrorism scholarship. This study conducted an original theoretical investigation into the tensions between counter-terrorism imperatives and democratic rights in Nigerian counter-terrorism policing, developing a normative-descriptive theoretical framework. A constitutional, jurisprudential, and empirical methodology was employed, combining analysis of relevant constitutional provisions and judicial decisions, systematic review of 58 counter-terrorism policing theory publications from 2018 to 2024, and structured interviews with 25 security scholars, constitutional lawyers, human rights advocates, and counter-terrorism officials. The systematic review confirmed that existing counter-terrorism policing frameworks (pre-crime policing, intelligence-led counter-terrorism, whole-of-government approaches) are derived from liberal democratic states with robust rule-of-law infrastructure that inadequately accounts for the enforcement environment of transitional democracies with weak institutions. The original Nigerian Democratic Counter-Terrorism Policing Framework proposes that in the Nigerian context, four tensions are constitutive rather than merely incidental to counter-terrorism policing: pre-crime intervention versus presumption of innocence, intelligence informant use versus due process, emergency powers versus constitutional rights limits, and military support to civil authority versus civilian law enforcement primacy. Each tension is theorised with specific constitutional and operational implications. Expert review by 20 counter-terrorism law and policing specialists confirmed original theoretical contribution.
