Applying Classical Rhetorical Principles in Contemporary Nigerian Legal Advocacy: A Professional Training Framework

Classical rhetoric, systematised by Aristotle, Cicero, and Quintilian, remains the foundational intellectual framework for persuasive legal advocacy, and its formal integration into Nigerian legal professional development represents an underexplored but promising training resource. This study develops a professional training framework for Nigerian legal advocates grounded in classical rhetorical principles, with specific application to the Nigerian judicial context. A professional development methodology was adopted, combining analysis of classical rhetorical treatises (Aristotle's Rhetoric, Cicero's De Inventione and De Oratore, Quintilian's Institutio Oratoria) with structured review of advocacy standards published by the Nigerian Bar Association and analysis of model advocacy transcripts from the Court of Appeal, Lagos and Abuja Divisions, from 2019 to 2023. Interviews with fifteen senior advocates and five judicial officers provided professional context. Findings indicate that formal rhetorical training is absent from Nigerian legal professional development curricula despite evidence that advocates with access to classical rhetorical education demonstrate measurably stronger argument structuring and persuasion skills. The proposed training framework encompasses the five canons of rhetoric (inventio, dispositio, elocutio, memoria, and pronuntiatio) adapted for Nigerian forensic contexts, with case studies drawn from landmark Nigerian Supreme Court judgments. The study recommends adoption of the framework as a continuing professional development module by the Nigerian Bar Association Institute of Continuing Legal Education.
