Host Community Development Trusts Under the PIA 2021: Early Implementation Challenges in Akwa Ibom State

This study investigates the early implementation of Host Community Development Trusts (HCDTs) as established under the Petroleum Industry Act 2021 in selected oil-producing communities in Akwa Ibom State, South South Nigeria. The PIA mandates that upstream petroleum companies contribute three percent of their annual operating expenditure to HCDTs for the benefit of host communities. Drawing on qualitative interviews with forty community members, four company liaison officers, and two legal practitioners in Uyo and Ikot Abasi, the research identifies structural and procedural obstacles in the trust establishment process. Documentary analysis of HCDT incorporation filings and community agreements adds a quantitative dimension to the study. Key findings reveal delays in trust incorporation, disputes over board composition, and confusion regarding the scope of eligible community development projects. The study recommends clearer regulatory guidance from the NUPRC, capacity-building programmes for community trustees, and standardised reporting templates. The research is directly relevant to the communities of Akwa Ibom State and provides a template for evaluating HCDT performance across Nigeria's oil-producing regions.
