Petroleum Operations and Fisheries Conflicts: Legal Remedies Available to Fishing Communities in Ondo State

This study examines the legal remedies available to fishing communities in Ondo State, South West Nigeria, whose livelihoods are adversely affected by offshore and onshore petroleum operations in the Bitumen Belt and adjacent coastal waters. Conflicts between petroleum operators and fishing communities often involve contested claims over oil spill compensation, restricted access to fishing waters, and disruption of aquatic ecosystems. The research employs a qualitative legal analysis approach, conducting interviews with twenty-five fishermen in Ilaje and Ese Odo LGAs and reviewing relevant judicial decisions, NOSDRA enforcement actions, and compensation claims filed with oil companies between 2020 and 2024. Findings indicate that fishing communities have limited practical access to legal redress due to costs, evidentiary difficulties, and inadequate legal aid. The study recommends the establishment of a community legal aid fund specifically for environmental claims against petroleum operators and clearer standards for fishing community compensation under the PIA 2021.
