Professional Standards for Sharia Compliant Contracts in Nigerian Real Estate Transactions

Real estate transactions in northern Nigerian Muslim communities and among Muslim property developers and investors nationally increasingly require Sharia-compliant contractual structures that avoid riba in financing arrangements, excessive gharar in property descriptions, and speculative conditions that violate Islamic commercial law. The absence of professional standards for Sharia-compliant real estate contracts in Nigeria creates legal uncertainty and transactional risk. This study develops professional standards for Sharia-compliant contracts in Nigerian real estate transactions. A professional legal drafting research methodology is applied, reviewing classical Islamic property transaction doctrines (Bai' al-Sarf, Ijara wa Iqtina, Diminishing Musharaka) and their application to property finance, alongside the requirements of the Nigerian Land Use Act 1978, the Mortgage Institutions Act, and CBN Islamic banking financing guidelines. Structured interviews with fifteen Islamic banking practitioners, ten real estate lawyers, and eight Sharia scholars provide practice insights. The study evaluates Sharia compliance requirements for property sale contracts, Islamic mortgage structures, Waqf property transfer instruments, and lease-to-own Ijara arrangements. Available professional Islamic real estate literature from Nigeria identifies the mis-structuring of Islamic mortgages as quasi-conventional loans with Islamic labels as the primary compliance risk. The AAOIFI Standards on real estate and Ijarah Muntahia Bittamleek provide the professional standard reference. Recommendations include model Sharia-compliant property sale and Islamic mortgage contract templates, professional conveyancing guidance, and a certification scheme for Sharia-compliant property transactions in Nigeria.
