Regulatory Effectiveness and Environmental Governance in the Niger Delta Oil Sector

This study empirically examines the effectiveness of regulatory institutions in governing environmental outcomes in Nigeria's oil-producing Niger Delta region, encompassing Rivers, Bayelsa, and Delta States in the South South geopolitical zone. Despite a comprehensive regulatory architecture, including the Department of Petroleum Resources (DPR), the National Oil Spill Detection and Response Agency (NOSDRA), and the National Environmental Standards and Regulations Enforcement Agency (NESREA), environmental degradation from oil spills and gas flaring persists at high levels. A mixed-methods design is employed, combining analysis of official oil spill data from 2018 to 2023 with 42 in-depth interviews with regulatory officials, oil company compliance officers, environmental advocates, and affected community leaders. Regulatory Capture Theory and the Responsive Regulation Framework by Ayres and Braithwaite jointly provide the theoretical foundation. Findings reveal systematic regulatory capture of the DPR and NOSDRA by the oil industry, manifested in under-reporting of spill volumes, negotiated rather than statutory compliance timescales, and inadequate penalties. Community-based environmental monitoring where independent organisations verify spill reports is associated with higher regulatory enforcement rates. Recommendations include the operational independence of NOSDRA from industry influence, introduction of strict liability for oil spills regardless of cause, and mandatory community environmental monitoring as a regulatory co-production mechanism.
