The Application of Alternative Dispute Resolution in Resolving Commercial Partnership Disputes in Kano

Commercial partnerships in Kano's textile, leather, and trading sectors are a central feature of the North West economy, and disputes between partners frequently threaten business continuity and personal relationships. This study examines the application of alternative dispute resolution mechanisms, including mediation, arbitration, and hybrid processes, in resolving commercial partnership disputes in Kano State. Using a practitioner-oriented research design, the study conducts semi-structured interviews with 30 commercial mediators, arbitrators, and business lawyers in Kano, supplemented by analysis of 45 partnership dispute files from the Kano Multidoor Courthouse between 2019 and 2024. The research evaluates the suitability of different alternative dispute resolution methods for various categories of partnership conflict including profit-sharing disputes, asset distribution disagreements, and governance deadlocks. Findings reveal that mediation is most effective for ongoing commercial relationships due to its interest-based approach, while arbitration is preferred for complex financial disputes requiring expert adjudication. The study also documents how cultural and religious factors unique to Kano's commercial environment shape parties' choices between formal and informal dispute resolution. Recommendations include the development of a specialised commercial partnership dispute resolution protocol, mandatory mediation clauses in partnership agreements, and capacity-building programmes for Kano-based commercial mediators.
