The Contributions of Traditional Institutions to Human Rights Protection in Yoruba Communities of Southwest Nigeria

This research analytically and empirically examines the contributions of traditional institutions, including Obas, councils of chiefs, and community dispute resolution mechanisms, to human rights protection in Yoruba communities of Southwest Nigeria. International human rights scholarship has largely engaged critically with traditional institutions as potential violators of human rights through discriminatory customary practices, while the constructive contributions of such institutions to rights protection in contexts of weak state presence have received comparatively less analytical attention. The study draws on legal pluralism theory, the UN Declaration on Human Rights Defenders' provisions on community protection, and African human rights scholarship on the contribution of traditional norms to rights protection. An empirical qualitative methodology employs focus group discussions and key informant interviews with traditional rulers, community members, civil society researchers, and state government liaison officers in Oyo, Osun, and Ekiti states. Analysis identifies domains in which traditional institutions actively protect rights, including land dispute resolution, protection of vulnerable community members from exploitation, and mediation of family disputes. Findings reveal a complex picture in which traditional institutions simultaneously contribute to rights protection in some domains while perpetuating discriminatory practices in others, particularly regarding women's inheritance and widowhood. The study develops an analytical typology of traditional institution human rights behavior. Recommendations center on structured engagement between state human rights bodies and traditional institutions to reinforce protective functions and reform harmful practices.
