Petroleum Dispute Mediation: Developing a Professional Mediation Framework for the Nigerian Petroleum Sector

This study develops a professional mediation framework tailored for the resolution of petroleum industry disputes in Nigeria, addressing the inadequacy of existing ADR mechanisms for the sector's technical complexity and multi-party dynamics. Petroleum disputes in Nigeria range from inter-operator disagreements and government-contractor conflicts to community-company grievances, each requiring different mediation competencies. Using a professional legal design methodology, the research analyses the outcomes of petroleum mediations conducted through the Lagos Multi-Door Courthouse, the Nigerian-British Chamber of Commerce Arbitration Centre, and NUPRC dispute resolution processes from 2019 to 2024. Interviews are conducted with eight senior petroleum mediators and six industry legal counsel. Findings reveal an absence of petroleum-sector-specific mediator accreditation and limited use of technical expert consultation in petroleum mediation proceedings. The study proposes a Petroleum Industry Mediation Protocol, including specialist mediator certification requirements, technical advisory panels, and tiered mediation escalation procedures.
