Professional Development of Female Practitioners in Islamic Law in Northern Nigeria: Barriers and Opportunities

📖 ABSTRACT/OVERVIEW

The professional participation of women in Islamic legal institutions, including as Sharia court judges, Islamic scholars, legal practitioners, and Zakat administrators, is a subject of evolving Islamic jurisprudential debate with significant practical implications for gender equity in the Islamic justice system of northern Nigeria. This study examines the professional development barriers and opportunities for female practitioners in Islamic law across northern Nigerian states. A professional survey and interview methodology is applied to seventy female Islamic law graduates and practitioners across Kano, Sokoto, Kaduna, and Bauchi States, alongside thirty institutional decision-makers in judicial service commissions, Islamic organisations, and law firms. The study investigates doctrinal positions on female judicial authority, institutional appointment practices, gender-based professional development barriers, and comparative examples from Muslim-majority states with female Qadis. Available professional Islamic legal career literature identifies the absence of female Sharia judges as the most prominent institutional gender gap in northern Nigerian Islamic legal practice. The contemporary jurisprudential debate on Qadi Hukmha, including positions of scholars like Yusuf al-Qaradawi, provides the doctrinal framework. Findings are expected to reveal a combination of doctrinal contestation and informal institutional exclusion as compounding barriers. Recommendations address appointments protocols, female Islamic law faculty mentoring, professional association advocacy, and Ijtihad-based doctrinal reasoning for expanded female judicial roles. Keywords: female Islamic law practitioners, professional development, northern Nigeria, Sharia judiciary, gender equity.
