Professional Analysis of Cross-Border Islamic Finance Transactions Between Nigerian and Gulf Cooperation Council Institutions

Cross-border Islamic finance transactions between Nigerian non-interest financial institutions and Gulf Cooperation Council-based Islamic banks involve complex Sharia governance, regulatory compliance, and conflict of laws questions that require professional legal analysis. As Nigerian Islamic banks seek correspondent banking, syndicated Islamic financing, and Sukuk co-issuance arrangements with Gulf institutions, the professional management of Sharia compliance across different national Islamic finance regulatory frameworks becomes critical. This study analyses the professional and legal framework governing cross-border Islamic finance transactions between Nigerian and GCC institutions. A comparative professional legal analysis is applied, reviewing CBN non-interest finance guidelines, UAE Central Bank Islamic finance regulations, Kuwait Finance House correspondence practices, and AAOIFI transnational transaction standards alongside structured interviews with fifteen Islamic banking practitioners from Nigerian and GCC-based institutions operating in Nigeria. The study evaluates the recognition of foreign Sharia board approvals, conflict of laws issues in Islamic financial contracts, and the enforceability of cross-border Islamic finance agreements under Nigerian courts. Available professional Islamic finance literature identifies the absence of mutual recognition agreements between Nigerian and GCC regulatory authorities as the primary transaction friction point. The IFSB cross-border supervisory cooperation standards and the UNCITRAL private international law framework provide the analytical reference. Findings are expected to reveal significant regulatory coordination gaps. Recommendations address CBN-GCC central bank Memoranda of Understanding, standardised Sharia cross-border contract templates, and professional training for Nigerian Islamic finance lawyers.
