A Professional Assessment of Employment Tribunal Practice and Workplace Dispute Resolution in Nigeria

The National Industrial Court of Nigeria serves as the primary judicial forum for employment and labour disputes, and the effectiveness of its dispute resolution processes has significant implications for labour relations stability, employer compliance, and worker rights protection across all geopolitical zones. This study provides a professional assessment of National Industrial Court practice across its principal registries in Lagos, Abuja, Port Harcourt, Enugu, and Kano, examining case disposition timelines, costs of access, procedural innovations, and outcomes across different claim types. Data were gathered from NIC case registers, interviews with 20 employment lawyers, five NIC judges, and 30 workers and employers who had participated in NIC proceedings. Results indicate that average case disposition at the NIC has reduced from 36 months to approximately 22 months following docket management improvements, but remains excessive for routine employment disputes. Cost and distance deter many workers in North West and North East Nigeria from accessing the NIC. Pre-hearing mediation has reduced contested hearings in approximately 40 percent of enrolled cases. The study concludes that NIC practice requires further reform including circuit sitting in geopolitically underserved states, mandatory pre-filing mediation for employment disputes, and online case management to reduce hearing delays. Recommendations include expanded NIC circuit registries in Kaduna, Ibadan, and Calabar and a mandatory early neutral evaluation programme for unfair dismissal cases.
