State Formation, Political Order, and the Persistence of Informal Governance in Nigeria: A Theoretical Reconstruction

This study offers a theoretical reconstruction of the conditions under which informal governance institutions persist alongside and within formal state structures in Nigeria, contributing to the comparative politics literature on hybrid political orders in post-colonial states. Existing theories of state formation largely derived from European historical experience inadequately explain the Nigerian trajectory, in which the formal apparatus of a modern Weberian state coexists with robust informal governance arrangements that frequently determine the actual allocation of security, justice, and public goods. Drawing on a combination of historical institutionalism, political settlement theory, and neo-patrimonialism literature, the study develops an original mid-range theoretical framework that conceptualises Nigerian governance as a stratified order in which formal institutions provide legitimating facades while informal networks of patronage, ethnic alliance, and transactional exchange govern substantive political outcomes. The theoretical claims are grounded through comparative process-tracing in three governance domains: security sector management, land administration, and judicial appointments, drawing on archival research, elite interviews, and case documentation across the South South, North West, and North Central geopolitical zones. The study finds that informality persists not as a residual pre-modern form but as an actively reproduced institutional arrangement that serves the distributional interests of dominant political elites while imposing systematic exclusion costs on marginalised groups. The theoretical framework advances the comparative understanding of post-colonial state development and offers analytical tools applicable to other African political economies. Recommendations from the applied dimension include reforms that reduce the distributional advantages of informality for elites, creating incentives for institutionalised governance.
