Professional Assessment of the Legal and Regulatory Framework for Cooperative Societies in Nigeria

The legal and regulatory environment governing cooperative societies in Nigeria, anchored by the Cooperative Societies Act and state-level cooperative laws, shapes the operational context, governance obligations, and developmental potential of cooperatives nationwide. This study conducted a professional assessment of the adequacy and effectiveness of Nigeria's legal and regulatory framework for cooperative societies, comparing federal provisions with the laws of six states representing each geopolitical zone. A comparative legal analysis methodology was employed, combining statutory analysis of the Cooperative Societies Act, state cooperative laws, and relevant judicial decisions with structured interviews with eighteen cooperative lawyers, state cooperative registrars, and national cooperative policy officials. Assessment criteria covered membership rights protection, governance requirements, dispute resolution mechanisms, regulatory oversight authority, and alignment with ICA cooperative principles. Results identified significant inconsistencies between state-level cooperative laws and federal provisions, creating regulatory confusion in multi-state cooperative operations. Dispute resolution mechanisms were inadequate in 83.3 percent of state laws reviewed, lacking timelines and enforcement provisions. Only two of six reviewed state laws had been updated since 2010, leaving regulatory provisions misaligned with digital financial practices, limited liability membership, and international cooperative governance standards. The study concludes that Nigeria's cooperative legal framework is fragmented and outdated, and recommends a comprehensive legal reform process producing harmonised model cooperative legislation adaptable by states, guided by ICA cooperative legal principles.
